All products and services offered by J.A.Severn Pty Ltd known as “The Seller or We or the Company” are sold only on the terms and conditions stated herein and except as required by law.

 

ORDERS

Placement of any order either verbally or in writing or by electronic information transfer in response to the Sellers offer shall constitute recognition and acceptance, by the buyer of the Sellers Terms & Conditions of Sale as being the only ones that shall apply to the entire transaction.

 

PRICES

(a) Typographical and clerical errors are subject to correction.

(b) Prices quoted are for Products/Services only and do not include technical data, proprietary rights of any kind, patent rights, qualification, environmental other than the original manufacturers standard tests and other than Seller’s normal domestic commercial packaging unless expressly agreed to in writing by Seller.

(c) All prices maybe subject to price variation where the exchange rate variation exceeds the base rate indicated on the price by +/ - 3%.

 

TERMS OF PAYMENT

All payments for products made by either Visa or Mastercard attract a 1.5% fee. 

 

RETENTION OF TITLE

Title to the goods supplied by the Seller to the Buyer, shall not pass to the Buyer until payment is received in full by the Seller.

 

DELIVERY DATES

After receipt of an order it takes 2-4 working days to process, pick and despatch an order.  The dates at checkout for Australia Post Regular & Express Post is linked directly to Australia Post website and it their estimated time allowance as per their schedule and is not controlled or estimated by us and commences from the time of pick up and maybe subject to delays from causes beyond our control. We do not accept responsibility for damages or loses, consequential or direct of any kind resulting from failure to deliver as quoted. In all offers the products & services are subject to prior sale or booking. WARRANTIES WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED . WHETHER OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE OR OTHERWISE EXCEPT AS REQUIRED BY LAW AND AS FOLLOWS:

 

All goods are warranted, for a period of ninety (90) days from the date of shipment, to meet the original manufacturer’s published specifications and to be free from defects in materials and workmanship when supplied. Our obligation under this warranty shall be limited to repair or replacement of goods proven within the warranty period to have been defective at the time of shipment. Upon discovery of any such defect, you shall promptly notify us thereof, and, if requested by us, return the defective goods to us. You shall be responsible for all expense of removal, freight and reinstallation in connection with repairs or replacement of defective goods. In no event shall we be responsible or reimburse you for repairs or replacement made by others. In no event and under no circumstances shall we be liable for loss of anticipated profits or for interruption of operations or for any special, incidental or consequential damages of any kind whatever so ever.

 

DELIVERY CHARGES

Our webshop is directly linked to Australia Post schedule price list and we have no control over it's pricing.

 

RETURNS

No goods sold and delivered may be returned to us without our prior written authorisation via a return material authorisation number (RMA). A restocking fee of 25% applies to all returns which relate to incorrectly ordered goods or order cancellations.

 

LAW APPLICABLE

All matters relating to the making, validity, construction and performance of this agreement shall be governed by the laws of NSW within the Commonwealth of Australia.

 

VARIATION

No variation of these terms and conditions shall be binding on the co mpany unless approved in writing by the company, notwithstanding that the variation may be made by conduct.
